Copyright, AI, and the Productivity Commission

A free ASA member briefing

The creative industries have responded with great concern to the Productivity Commission’s recent proposal to explore a text and data mining (TDM) exception to Australia’s Copyright Act, allowing for the training of AI models on copyright work

Large language models have already been trained on vast amounts of Australian creators’ work including books, journals, essays, and articles – without consent or compensation. The Productivity Commission report acknowledges that theft, yet is still seeking feedback on a proposal to authorise such use.

“A text and data mining exception would mean that some of the wealthiest corporations in Big Tech would be able to freeload from low-paid authors’ labour. It would institutionalise wage theft for those working in creative industries.” – Josh Bornstein, lawyer, author, and ASA Director
